Seeding Privacy Notice

Effective Date: April 16, 2026

[Samyang Popow Inc.] (Popow Inc., we, us, our, and their equivalents) values your privacy and wants to make sure you understand how we handle your information when you participate in a seeding campaign. This Seeding Privacy Notice supplements our general Privacy Policy and applies only when we collect shipping-related Personal Information from you for product seeding. If any provision of this notice conflicts with our Privacy Policy with respect to seeding-related data, this notice will control.

This notice is not intended for children under 13, and our seeding campaigns are not available to users under 18. If you believe that a child under 13 has provided Personal Information to us through a seeding campaign, please email us at help@popow.ai.

When This Notice Applies

This notice applies when you voluntarily apply to a seeding-enabled campaign on the Popow platform and submit the Seeding Address Form to receive a brand-provided product. It does not apply to non-seeding campaigns or to your general use of our Service.

Personal Information We Collect

When you complete the Seeding Address Form, we collect the following categories of Personal Information:

  • Identifiers, such as your first name and last name.
  • Contact information, such as your phone number and email address.
  • Geolocation information, such as your street address, city, state, ZIP code, and country, which you provide so that the product can be shipped to you.
  • Commercial information, such as optional shipping notes (for example, apartment codes or drop-off instructions) that help the carrier deliver your product.

We do not collect clothing sizes, date of birth, Social Security Number, financial account information, race, religion, health data, biometric data, or precise real-time location unless a future campaign explicitly requires it and provides you with a separate notice before collection.

Although your shipping address may technically constitute "precise geolocation information" under CCPA/CPRA §1798.140(ae), we use it only to deliver the product you requested — a service reasonably expected by an average consumer — and therefore the right to limit the use of sensitive Personal Information under §1798.121 does not apply to this collection.

How We Use Personal Information

We use the Personal Information you provide through the Seeding Address Form solely to arrange and complete delivery of the brand-provided product for the specific Campaign you joined. We do not use this information for marketing, for enriching your Creator profile, or for any secondary purpose not described in this notice.

We may also use your email address or phone number to send you delivery-related notifications, such as shipping confirmations and tracking updates, consistent with the CAN-SPAM Act (15 U.S.C. §7701 et seq.) and the Telephone Consumer Protection Act (47 U.S.C. §227). We will not use either channel to send you marketing messages in connection with this notice.

We do not use the Personal Information collected through the Seeding Address Form for automated decision-making or for profiling that produces legal or similarly significant effects concerning you.

Disclosure of Personal Information

To deliver the product you requested, we share the Personal Information you provide with the following parties:

  • Campaign Brand Sponsor: The Brand receives your name, shipping address, phone number, optional shipping notes, and email address (for delivery notifications). The Brand acts as Popow's processor (a "service provider" or "contractor" under CCPA/CPRA and a "processor" under the Delaware Personal Data Privacy Act) for this limited shipping purpose. Under the Campaign Agreement with Popow, the Brand may use your information only to ship your product for this Campaign and must not use it for marketing, add it to a CRM, share it with other brands, or retain it beyond the delivery window.
  • Shipping carriers and third-party logistics providers: The Brand engages shipping carriers or 3PL providers as sub-processors to deliver the product. These sub-processors receive only the information needed to complete delivery and are bound by obligations equivalent to those above.

Because you voluntarily directed us to provide your shipping information to the Brand for product delivery, and because the Brand's use is contractually limited to shipping, this disclosure is not a "sale" or "share" of Personal Information under CCPA/CPRA §1798.140(ad)(2)(A)(B) or the Delaware Personal Data Privacy Act §12D-107.

International Data Transfers

As described in our Privacy Policy, we process Personal Information on servers located in various jurisdictions, including the Republic of Korea. In addition, when the Campaign Brand is located outside the United States (for example, in the Republic of Korea), your shipping information may be transferred to and processed in the Brand's home jurisdiction for the sole purpose of arranging shipping. Popow only transfers your information pursuant to legally valid transfer mechanisms and ensures that the processor obligations described above continue to apply.

Security and Retention

We implement commercially reasonable technical, administrative, and organizational measures to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The Brand is contractually required to maintain equivalent safeguards, including encryption in transit and at rest, access controls, and secure deletion procedures.

We will delete your Seeding Address Form data from our systems within 30 days after the Brand confirms delivery. The Brand is required to delete your shipping data (and ensure that its sub-processors delete it) once delivery is confirmed and any applicable return window has passed. Shipping carriers may retain data as required by their standard policies for delivery confirmation and dispute handling. We may retain de-identified or aggregated data for analytics and compliance purposes indefinitely.

Your Rights

Depending on where you live, you may have certain statutory rights in relation to your Personal Information. For example, you may have the right to:

  • Access your Personal Information and information relating to how it is processed
  • Correct inaccurate Personal Information
  • Delete your Personal Information from our records (subject to active shipping obligations and legal retention requirements)
  • Not be discriminated against for exercising any of your privacy rights

You may exercise these rights by emailing us at help@popow.ai. To protect your Personal Information from unauthorized access, change, or deletion, we may require you to verify your identity before we respond. If we cannot verify your identity, we will not be able to honor your request. You may also submit a rights request through an authorized agent, who must present signed written permission to act on your behalf. Authorized agent requests can be submitted to help@popow.ai.

We will respond within the timeframes required by applicable law, generally within 45 days, with an extension of up to an additional 45 days where permitted.

State-Specific Rights

California Residents (CCPA/CPRA). You have the rights described above, plus the right to request information about the categories and specific pieces of Personal Information we collected in the preceding 12 months, the sources, the purposes, and the recipients. As explained under "Disclosure of Personal Information," the transfer of your shipping information to the Brand is a processor relationship and not a "sale" or "share" of Personal Information, and no "Do Not Sell or Share" action applies to seeding data. Under California's Shine the Light law (Cal. Civ. Code §1798.83), you may also request information about our disclosure of Personal Information to third parties for their direct marketing purposes; Popow does not make such disclosures, but if you wish to receive a formal response, please email us at help@popow.ai.

Delaware Residents (DPDPA, effective January 1, 2025). You have the rights described above, plus the right to appeal a decision we make relating to your privacy rights requests. To appeal, please send your request to help@popow.ai with the subject line "DPDPA Appeal" within 30 days of receiving our response. We will respond within 60 days and explain our decision, including information on how to contact the Delaware Attorney General if you remain unsatisfied.

Other US State Residents. If you reside in a state with a comprehensive privacy law (such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Tennessee, Montana, Indiana, Iowa, New Hampshire, New Jersey, Kentucky, Maryland, Minnesota, Nebraska, or Rhode Island), you may have equivalent access, correction, and deletion rights. Changes to This Notice

We may update this notice from time to time. When we do, we will post an updated version with a revised "Effective Date," unless another type of notice is required by applicable law. Your continued participation in a seeding campaign after a material change constitutes acceptance of the updated notice.
